These terms govern the delivery of an AI Operating System, referred to here as an AIOS. They are part of our Terms of Service and are incorporated into them by reference.
You are buying an outcome. The outcome is produced by a client-installed AI Operating System built and configured by Be Socially Smashing LLC.
You are not buying software. You are not buying a subscription to a product. You are not buying the system that produced the outcome.
What is delivered is one version, fixed at the point of delivery. Each installation carries a manifest that identifies the release and states its scope, including what that release does not do. The manifest is the description of what you bought.
The engine remains ours. That includes the architecture, the skills, the prompts, the governance rules, the sequencing, the configuration, the methods, and the frameworks behind the build. The how behind the build remains ours.
You may keep your installation. You may run it. You may change it. You may use everything it produces for your own business, commercially, for as long as you like.
You may not license it. You may not resell it. You may not redistribute it. You may not sublicense it. You may not deliver the engine to a third party as a product, a service, or a component of either. You may not make it available to anyone as something they can buy, rent, or use in place of buying it from us.
Modifying your installation does not change this. A modified copy is still built on our engine, and the restrictions in this section apply to it in full.
Think of it the way a newsletter works. While you are engaged with us, you receive the outcome of the next version if you choose to take it. When the engagement ends, you stop receiving new versions. That is the entire consequence.
What you already received stays yours. We do not remove it, disable it, or reclaim it. Your delivered version keeps working exactly as it was delivered.
We do not promise that any feature in one release appears in the next. A later version is a separate decision and a separate purchase. We are not obligated to build one, offer one, or support the one you hold.
An AIOS runs on artificial intelligence, including large language models operated by third parties.
Output can be wrong. It can be incomplete. It can be out of date. It can read as confident and still be false.
You are responsible for reviewing every output before you use it, publish it, send it, or rely on it. Nothing an AIOS produces is legal, financial, tax, medical, accounting, or other professional advice, and nothing it produces creates a professional relationship of any kind.
An AIOS depends on services we do not own or control. That includes model providers, code hosting, deployment platforms, and the accounts you hold with them.
Their availability, pricing, rate limits, model behavior, feature changes, and decisions to discontinue a service are outside our control. We make no guarantee about any of them. You are responsible for the accounts you hold and for the terms you agreed to with those providers.
An AIOS proposes. You decide.
It does not send email, publish content, deploy to a live site, make a purchase, or transact on your behalf without your approval. Once you approve an action, that action and its consequences are yours.
What you put into your installation stays in your repository. Our build materials and your live installation are kept in separate repositories that do not touch.
We do not share one client's material with another client. We do not reuse your content, your data, or your business information to produce someone else's outcome.
If your installation will handle personal information belonging to your own customers, employees, or contacts, tell us before it does. That relationship carries obligations that are handled in your engagement agreement, not on this page.
Your delivered version conforms to the description and the scope stated in its manifest at the time of delivery. Conformity is measured against that description and nothing else.
Where the law of your home jurisdiction requires us to supply updates needed to keep a delivered version in conformity with what was agreed, we supply those updates for the period that law requires. That does not entitle you to new features, added capability, or a later version. Those remain a separate decision and a separate purchase.
You are working with a system that uses artificial intelligence. Content it produces is generated or assisted by artificial intelligence.
Where you publish, distribute, or place AI-generated or AI-modified content into any market that requires it to be disclosed, labeled, or marked as artificial, that disclosure is your responsibility as the publisher.
Some jurisdictions grant buyers rights that cannot be waived by agreement. Nothing in this document limits or removes any such right.
Where a mandatory rule of your home jurisdiction conflicts with a term here, that rule applies to the extent of the conflict, and every other term in this document stands.
Governing law and venue are stated in our Terms of Service and apply to this document without change.
